I am an NRI and have purchased two flats in Redwood Tower in Runwal Greens in Mulund, Mumbai.
I would like to bring to your notice the unreasonable demand by the builder, Runwal, which is unnecessary harassment to us. The builder is not sharing the necessary approvals which is a requirement under MOFA and is not forwarding the Sale Agreement for our review and registration. We have made payment of 87% to the builder and have also paid 87% of the amount towards Club house charges , 18 months maintenance charges, Infrastructure charges, society charges, etc.

Its only when we called them after not getting any response to our emails we were informed that about additional exorbitant charges of Rs 18 lacs which is almost 15% of my purchase cost. This came as total shocker & creating huge anxiety & grief as the main reason of paying 87% up-front was primarily to have full visibility & cap the cost.

This was a total shock to us as the Agreement we made with the builder was for an all inclusive amount and also the building ( Redwood tower in Runwal Greens) where we have purchased the apartment was launched in the last phase and did not have balconies / flowerbeds.
Appreciate your assistance in guiding to resolve the issue. we have paid entire savings of our life and with such unreasonable demands and no response from the top management including owner overseeing this project we are left with no option. Please advise whom do we approach for resolution

Hi Deepa,

That is a lot of payment without signing the sale agreement. Normally, only a token advance is paid before signing the sale agreement and then the rest of the amount is paid. I understand that this was done to limit the charges but there could be a thousand reasons that the builder might cite to increase sale price.

I would suggest that all the affected owners form a group. You could form a group using one of the social platforms available or through our group management facility which can be set to private mode.

Once you have formed a group, you could approach a lawyer and through him approach the district consumer forum, which is quick and inexpensive to resolve such consumer issues. I hope that some of the members are not NRIs and are actually present in Mumbai.
