Hello All,

Im planning to buy 2BHK flat (1st Floor ) in group house building which was constructed in 2211 Sq Ft in chennai Thoraipakkam.

Building Approved for Ground Floor + First Floor
Ground Floor (1BHK + 2BHK) constructed in 1164 Sq Ft with only one car parking .

First Floor ( 2 BHK + 2BHK) constructed in 1335 Sq Ft

FSI = 1.13

In building approval 2nd floor is completely for OPEN terrace , but builder constructed 2BHK flat in second floor.

Now my Questions are :

1.In this building can i buy apartment in 1 St floor.

2.Now builder is planning to get approval for his 2 nd floor flat , can he get the approval for it ?

3.Since the 2 nd floor is not approved , can i buy flat in 1 St Floor ..why i am asking is in future government decide to demolish the 2nd floor , then my flay in 1 st floor also will get damage right.

4.though 2nd Floor is not approved , UDS is allocated.(think 430 sq ft)

5. What is the over all opinion and incase if i but flat in 1 st floor , infuture what problems i will face.

1) If you buy a unit in first floor, there is the risk that when second floor is demolished, the first floor's roof would also be impacted.

2) If the builder has premium FSI, then he could try. However, that should be got before construction. Since he is trying to get it after construction, it is doubtful. It rather might be a ploy to get buyers to buy flats in first and second floor.

3) Normally, buyers in second floor dont get any UDS, That is why flats in 2nd floor are sold for cheap.

Overall, I would suggest you to keep on looking.
