Hi All,

I have a property of my mother who passed away recently, this was bought back in 1987, i wanted to sell that property. However, the buyer is asking for a GPA. I have all the necessary document other than the GPA - I have original Sale Deed That has been registered on my mother's name as the current owner of the property, i have the EC and all the years property tax receipts. I am not sure why a GPA is needed to sell this land. Can someone please help or suggest?

Hi James,

The buyer might be asking you for GPA since he might believe that it is the only document that would help him purchase the property. However, in this case since your mother has passed away, I would suggest that you obtain a certificate that you are the only remaining heir of the property. That can be gotten using death certificate of your mother.

This should suffice for selling the property.

Are we sure about this? Coz the buyer was asking GPA even when my mother was alive, so im kind of confused and would want to know why is this GPA so much necessary btw i have the death certificate handy. Should i ask the buyer to consult a lawyer and get a clean chit on the documentation i have? Please let me know.

The buyer must have then be rightly asking for GPA till your mother was alive. GPA stands for general power of attorney. Since the land belonged to your mother, when she was alive, she needed to execute a GPA giving you the right to sign on her behalf and close the deal.

Now that your mother had passed away, any existing GPA would anyway become invalid. Hence, you would need to get a legal certificate of ownership as the only legal heir.
