TOPIC: rectification of sale deed required

Hi Krishna,
We are planning to buy a property in moodalapalya, bangalore. we lied the property & negotiation done & fixed for agreement with some agreed amount. Then while checking the sale deed paper copy given by the owner, we observed it mentioned 900 sq feet as plot area. in real it has 30*36 =1080 sq feet.while going through the records, we found he got the approval for construction from BBMP based on the plot area 900sq ft. & constructed the building & built up area is almost 1000 sq feet on each floor (its a 3 floor building with 4th floor terrace+small 1 bed room house).
Now before making agreement, we asked the builder to get the paper corrected as per the real plot area. but he said no it is possible. Is there any way we can get the amendment done on the sale deed with mentioning the real plot size. or shall we drop the plan to go ahead with buying this property?
we are really in confusion & decided not go for this until the builder agrees to amend the real plot size on the new sale deed.
please advise, how do we proceed with this

Hi Latha,

The problem here would be that the owner or builder has built a property on it against the approved plan (exceeding the approved plan). Hence, he cannot approach the authorities now. Hence, it might be a good idea to not go ahead with this property.
