Hi,

My mother was purchased a property in 1990 but made GPA not registered... Since then we haven't paid tax and planning to pay now... When I visited to BBMP they were asking to get registered papers since GPA is not allowed. What should be the better solution in the following case to get registration ?
1) Still land owner is there and should we need to call land owner or my mother can do sale deed in favour of me ?
2) Or Gift Deed is enough ?

Do you mean to say that yourother purchased the property through GPA from landowner?

Yes my mother purchased this property and made GPA in my mother name which is duly registered and stamped.

You would need to reregister the land in your name since GPA is not allowed. However, ensure that the seller has the right intentions and will not demand for more money to sign the papers. The risk of that happening is very high.

Can we do register without calling him. I mean from my mother name to my name ?

Because if we call him then it will be high risk for us. He may ask more money.

Exactly, in all probability he will ask for more money. However, since your mother got the property through GPA, that transaction is at risk. A further sale to you itself might be invalid since the propery legally is still the previous owner's.

However, since this is for tax purposes, I believe making even a registered gift deed would solve the problem. However, do know that the parent deeds would continue to have a problem and would need to be resolved at some point of time, say at the time of reconstruction of house, sale, etc.
