TOPIC: GPA PROPERTY VALIDITY??

A GPA MADE BY Mr A TO Mr B ON 27/2/1984 where it is stamped with seal of "COURT OF SMALL CAUSES", Bangalore and signed by ADDITIONAL JUDGES on 28/2/1984(execution admitted before me(judges)).Further the land was sold by Mr B(as a Gpa holder)through sale deed to Mrs B(2003)>then to Mr C(2008)>then to Mr D(2012)>then to Mr E(2015).Now it's on sale.Can I buy the property??
Notes:
1)EC & TAX RECIEPT ARE UPTODATE.
2)MR E HAS GOT A LOAN FROM A NATIONALISED BANK FOR 75% of GUIDANCE VALUE ,EVEN THOUGH ITS a B KHATA PROPERTY.
3)MR E HAS DOCUMENTS FROM MOTHER DEED-MR Y sold to MR A THRU SALE DEED.

Hi Vishal,

I don't see any issue in buying this property. The only issue I might see is that there property is a b khata property. Has it been DC converted?

In mother deed it's registered as 1 gunta 498sft approx or 52.5*30.In further sale deed is registered as 40*30. And it's not DC converted.
But Gpa is not valid so is it valid to buy??

Generally, no sale should be done through GPS currently. However, if at the time of sale at that time, GPA was valid, then the property could be safe.

However. Please ensure that the documents are right before going through with the purchase.

2nd-2008

So what's your final opinion??

If GPA was not cancelled till 2003, then it is safe to buy the land on GPA front.

Thus it isn't cancelled till present day.
But incase if the person who made the Gpa applies for possession ,will Gpa stand for me,as it would be sold 5 times by now??

That fear is always there. Sale through GPA has been made illegal in current times. Earlier out was used as a popular means of stamp duty evasion. Hence sale through GPA was common and not illegal. However, that risk will continue to exist. The safest way would be to avoid properties sold through GPA.
