This is a 900 Sqft land that I am planning to purchase in Blore , this land was alloted free of cost by govt as poor people land. This owner has gifted the land to his daughter and the plot is now in the name of the daughter who wants to now sell it. The owner (father) and the daughter are willing to sign the plot in my name n register in my name. The contract clearly says this is govt land approved by Bda given to poor and can't be sold. Can I purchase it . Does Bda consider it void if the transaction is made . Some say v can purchase and sell such land after 15 years. Note this is not Sc/st land but it's called as land given to poor . Pls assist immediately . Thanks a ton.

Hi Krithi,

I would advise you against buying land granted to poor. Grant land have special rules. I would suggest you consult a lawyer.

I purchased a 'B' Khatha resale property in 2011. In 2015 the parent owner son claiming this property belong to SC/ST granted by Govt to his Father.

In 2011, I followed the legal procedure Absolute Sale Deed and Khatha in under my name, also paid taxes to Govt.

Now the parties claiming an 5 lacs extra in 2016 to release the properties.

Please let me know, Since I was not aware that this was SC/ST property, All documents as per legal procedure in under my name even the Tasildhar signed the Deed and govt fees also paid

Will I get an justice, to retain my property.

Please advise.

Hi Ravi,

A property purchased from SC/ST cannot be said to have been purchased in ignorance. Ignorance all not give you a reason to protect your ownership of that property. Legal clause protects the weaker unless the person who sold the land tried to sell the property to you without letting you know that an SC/St owned it.
